SAN PABLO MAN CHARGED WITH MURDER FOR HIT-AND-RUN DEATH IN NORTH BEACH



SAN FRANCISCO, CA – District Attorney Kamala D. Harris announced today that Oscar Alejandre, 21, of San Pablo was charged with murder and other charges stemming from the February 19, 2010 hit-and-run death of Luis Armando Prieto, 21, of San Francisco.


"If you are involved in a shooting and then kill someone as you attempt to flee, that is not a traffic accident, it is murder," said District Attorney Kamala D. Harris.


Alejandre is scheduled for arraignment and plea in the Superior Court Tuesday, February 23, 2010 at 9:00 a.m. on charges of murder (Penal Code section 187(a)), gross vehicular manslaughter (Penal Code section 192(c)(1)), negligent discharge of a firearm (Penal Code section 246.3), hit-and-run causing death (Vehicle Code sections 20001(a) and 20001(b)(1)), possession for sale of methamphetamine (Health and Safety Code section 11378), transportation of methamphetamine (Health and Safety Code section 11379), possession of methamphetamine while armed with a firearm (Health and Safety Code section 11370.1), carrying a concealed firearm (Penal Code section 12025(a)(1)), carrying a loaded firearm (Penal Code section 12031(1)(1), a misdemeanor count of resisting arrest (Penal Code section 148(a)(1)), and a misdemeanor count of driving on a suspended license (Vehicle Code section 14601.1(a)).


Also charged were Fidel Bejarano, 24, of Hercules, California, and Andrea Luna, 22, of Richmond, California.


Bejarano is alleged to have also discharged his firearm on Broadway and was Alejandre’s passenger when Alejandre’s vehicle struck and killed Prieto. Bejarano is charged with negligent discharge of a firearm (Penal Code section 246.3), possession for sale of methamphetamine (Health and Safety Code section 11378), transportation of methamphetamine (Health and Safety Code section 11379), possession of methamphetamine while armed with a firearm (Health and Safety Code section 11370.1), felon in possession of a firearm (Penal Code section 12021(a)(1)), carrying a concealed firearm in a motor vehicle (Penal Code section 12025(a)(3)), carrying a loaded firearm (Penal Code section 12031(1)), and a misdemeanor count of resisting arrest (Penal Code section 148(a)(1)).


Luna’s purse was found in Alejandre’s vehicle and inside the purse was a concealed firearm. Luna is charged with possession for sale of methamphetamine (Health and Safety Code section 11378), transportation of methamphetamine (Health and Safety Code section 11379), possession of methamphetamine while armed with a firearm (Health and Safety Code section 11370.1), carrying a concealed firearm in a motor vehicle (Penal Code section 12025(a)(3)), and carrying a loaded firearm (Penal Code section 12031(1)). Bejarano and Luna are also scheduled for arraignment and plea Tuesday morning.


Alejandre was in court this morning on a bench-warrant return for a misdemeanor gun-possession case from 2009. Alejandre was a fugitive on that case with a $10,000 bench warrant at the time of Prieto’s death. Bail was reset by the court on Alejandre’s misdemeanor case this morning at $100,000.


The arrest of Oscar Alejandre, Fidel Bejarano and Andrea Luna is the result of a thorough investigation by San Francisco Police Department Inspector Dean Taylor and James Custer and SFPD officers from Central Station.
