DA HARRIS ANNOUNCES INDICTMENT OF 10 MEMBERS AND AFFILIATES OF “B.N.T.” STREET GANG FOR THREE MURDERS AND DOZENS OF OTHER FELONIES
Members of the Bayview’s “Broke Niggas Thievin’” Gang Indicted by San Francisco Grand Jury Following Three-Month Proceeding
SAN FRANCISCO, CA – District Attorney Kamala D. Harris announced today that the San Francisco criminal grand jury has indicted nine members and one affiliate of the “B.N.T.” (Broke Niggas Thievin’) street gang for three murders, including for the 2009 murder of Delvon Fields, and dozens of other felonies. The grand jury issued the indictment on February 25, 2010.“The crimes charged in this indictment are symptoms of the disease that has taken hold of San Francisco and every other major city in the state—and that disease is gang violence,” said District Attorney Kamala D. Harris. “We will approach the senseless violence gang members inflict on one another and on the community with the maximum force of the law and hold this case out as a reminder to our young people that gang life is a dead end.”
The Territory of the BNT street gang is Third Street surrounded by Newhall to the West, Mendell to the East, Kirkwood to the North and Newcomb to the South and an area surrounding Commer & Garlington Court. The gang has been implicated in dozens of violent crimes in San Francisco over the past several years. The San Francisco District Attorney’s Office had been investigating the BNT gang and beginning on December 1, 2009 the District Attorney’s office began presenting evidence of the gang’s crimes and criminal enterprise to the grand jury. The presentation of evidence took nearly three months and included the live testimony of 77 witnesses. At the close of evidence, the grand jury issued its indictment. Since the indictment issued on February 25, 2010, the San Francisco Police Department has been taking defendants into custody. The defendants are scheduled to be arraigned Tuesday morning, March 2, 2010 at 9:00 AM in Department 22 of the San Francisco Superior Court.
Included in the grand jury indictment are charges for the July 16, 2009 murder of Delvon Fields, who was shot and killed in front of his three children, his girlfriend, and his mother as they were driving on McKinnon approaching Third Street. It is alleged that London Shaw was the shooter and that Cyril Hanna and Cecil Terrell were in the vehicle, along with Missy Davis, who was driving the rental car. Missy Davis is also charged with murder as an accomplice.
Included in the indictment are charges for the October 13, 2006 murder of Lloyd Randleston, which occurred five days after his 21st birthday. It is alleged that Cecil Terrell, Antoine Fowler and Clark Benson were friends of Randleston and tricked him into accompanying them to the area with a ruse that they were going to retaliate against Oakdale, a rival gang. After walking behind Commer Court into a secluded area, Fowler began to ask Randleston about a gun he stole from the gang. Fowler then allegedly shot and killed his supposed friend, Randleston (helped by Clark Benson who had been seen moments before with an assault rifle).
Also included in the indictment are charges for the May 13, 2008 murder of Gregory Chapman, 46, who was shot during a robbery. Gregory Chapman was a motility bus driver and the father of three kids. It is alleged that Brian Yang's fingerprint was found on the victim’s sunglasses. In October, Brian Yang was arrested for possession of a gun in a vehicle.
The following defendants have been indicted on the charges detailed below (charge enhancements have been omitted):
§ London Shaw, 22: Murder of Delvon Fields (July 16, 2009); Conspiracy to Commit Robbery and Robbery (October 25, 2007); Possession of loaded firearm in vehicle (August 20, 2009). Shaw faces life in prison without parole.
§ Antoine Fowler, 25: Murder and Conspiracy to Murder Lloyd Randleston (October 22, 2007); Transportation of an Assault Rifle (March 4, 2006). Fowler faces life in prison without parole.
§ Clark Benson, 25: Murder and Conspiracy to Murder Lloyd Randleston; Robbery (October 22, 2007). Benson faces life in prison without parole.
§ Cecil Terrell, 23: Murder and Conspiracy to Murder Lloyd Randleston & Possession of over 28 grams of cocaine for sale (2008). Terrell faces life in prison without parole.
§ Brian Yang, 20: Murder and Conspiracy to Robbery of Gregory Chapman (May 13, 2008); Carrying a loaded firearm in a vehicle (October 21, 2008). Yang faces life in prison.
§ Cyril Hanna, 22: Robbery & Conspiracy to commit robbery (October 25, 2007); Robbery (August 8, 2008). Hanna faces over 30 years in state prison.
§ Julius Rhodes, 19: Robbery & Conspiracy to commit robbery (October 25, 2007). Rhodes faces 25 years in state prison.
§ James Talley, 22: Robbery & Conspiracy to commit robbery (October 25, 2007). Talley faces 25 years in state prison.
§ Thomas Sims III, 24: Possession of heroin for sale, over 28 grams; Possession of cocaine for sale, over 28 grams; Possession of an assault weapon; Possession of firearm by a convicted felon (October 21, 2009). Sims faces approximately 20 years in state prison.
§ Missy Davis: Murder and Accessory to Murder of Delvon Fields. Davis faces life in state prison.
Assistant District Attorney Eric Fleming did a first-rate job in presenting this complex case to the grand jury. He was assisted by Special Assistant District Attorney Evangeline Zimmerman. Assistant District Attorney and Head of the DA Homicide Unit George Butterworth and Assistant District Attorney and Head of the DA Gang Unit Wade Chow also assisted in the prosecution. Dozens of San Francisco Police officers from Bayview Station and other district stations, and Gang Task Force and Homicide inspectors investigated and developed these cases. San Francisco Police Department Officer Len Broberg of the Gang Task Force did a terrific job in investigating these cases and adding his skill, knowledge and effort to the grand jury proceedings.
