DRUG DEALER CONVICTED OF DOMESTIC VIOLENCE AND POSSESSION OF DRUGS FOR SALE
Jury Convicts Defendant of Possession for Sale of Drugs Originally Tested by the
Now-Closed Narcotics Division of the SF Police Department Crime Lab
SAN FRANCISCO, CA – District Attorney Kamala D. Harris announced today that a San Francisco jury convicted Jovaughn Timms, age 27 (Court Nos. 9000197 and 1001984) of multiple felonies, including a domestic violence charge, dissuading the victim from testifying, dissuading the victim from prosecuting the assault, and possession for sale of MDMA (commonly known as ecstasy).
The jury also convicted Mr. Timms of three misdemeanor stay-away violations and found true that Mr. Timms had previously been convicted on April 2, 2009 of domestic violence related charges.
The MDMA in this case was originally tested by the now-closed Narcotics Testing Unit of the San Francisco Police Department Crime Lab and was subsequently re-tested at the San Mateo Sheriff’s Department Crime Lab.
The guilty verdict was announced in Department 25 of the San Francisco Superior Court before the Honorable Christine Massullo. The defendant faces six years and four months in state prison for this conviction, plus additional time in state prison for violating his probation in Stanislaus County.
On December 14, 2010 the defendant, Mr. Timms, assaulted the victim after an argument relating to the defendant having sexual relations with another woman. During this confrontation, Mr. Timms punched the victim in the face. When officers arrested him he had 65 grams of MDMA on his person. While the defendant was in custody he made numerous phone calls to the victim where he attempted to dissuade her from testifying at a preliminary hearing.
The arrest and prosecution of defendant Jovaughn Timms is the result of a thorough investigation by San Francisco Police Department Domestic Violence Response Unit Inspector Pat Mullins, San Francisco Police Officers Raymond Padmore and Eric Whitney and San Francisco Deputy Sheriff Don Garcia. Christine Ticas is the Victim/witness Advocate assigned to the case from the District Attorney’s Office. Sam Totah is the Assistant District Attorney who prosecuted the defendant.
The sentencing date for the defendant is set for June 18, 2010 in Department 25 of the San Francisco Superior Court.
