Defendants Arraigned in German Tourist Murder Case

DEFENDANTS ARRAIGNED IN GERMAN TOURIST MURDER CASE

San Francisco District Attorney George Gascón announced today that defendants Phillip Stewart (DOB 3/15/1992, CN 11012091), Delvon Royal Scott, (DOB 12/11/1991 CTN: 11012096), Willie Charles Eason, (DOB: 1/18/1992 CTN: 11012092), Marcus Blueford, (DOB: 1/9/1992 CTN: 11012093), Gethsemane Pita, (DOB: 5/25/1992 CTN: 11012095) and Raheem Jackson, age 17 (charged as an adult) were arraigned in the August 2010 shooting death of 50-year-old Mechthild Schroer and the wounding of two other victims.

“Today marks the beginning of the justice process in this case,” said District Attorney George Gascón. “On August 8, 2010, harrowing, brazen and deadly actions took the life of victim, wounded two others and shocked the conscience of San Francisco. Assistant District Attorney Eric Fleming’s diligent and exacting work has brought the case to this point and will continue to move this case forward.”

On Tuesday, July 19, 2011, all six defendants appeared before the Honorable Jeffrey Ross in Department 12 of San Francisco Superior Court for arraignment. Each defendant was arraigned and pled not guilty. The defendants were arrested by the San Francisco Police Department on May 4, 2011 after the issuance of arrest and search warrants by the San Francisco District Attorney’s Office on May 2, 2011 and May 3, 2011.

Phillip Stewart (DOB 3/15/1992, CN 11012091) is charged with one felony count of murder in violation of Penal Code section 187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional use of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022(e)(1), an allegation of special circumstances in violation of Penal Code section 190.2(a)(22), several felony counts of attempted murder in violation of Penal Code section 664/187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional discharge of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022.53(e)(1), one felony count of participation in a criminal street gang in violation of Penal Code section 186.22(a), one felony count of assault with a semi-automatic weapon in violation of Penal Code section 245(b) and one felony count of possession of a firearm in violation of Penal Code section 12025(a)(2). Bail is set at $6 million. On Tuesday, July 19, 2011, defendant Stewart pled not guilty to all counts and allegations.

Delvon Royal Scott (DOB 12/11/1991 CTN: 11012096) is charged with one felony count of murder in violation of Penal Code section 187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional discharge of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022(e)(1), an allegation of special circumstances in violation of Penal Code section 190.2(a)(22), several felony counts of attempted murder in violation of Penal Code section 664/187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional discharge of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022.53(e)(1), one felony count of participation in a criminal street gang in violation of Penal Code section 186.22(a), one felony count of assault with a firearm in violation of Penal Code section 245(a)(2) and one felony count of possession of a firearm in violation of Penal Code section 12025(a)(2). Bail is set at $7 million. On Tuesday, July 19, 2011, defendant Scott pled not guilty to all counts and allegations.

Willie Charles Eason (DOB: 1/18/1992 CTN: 11012092) is charged with one felony count of murder in violation of Penal Code section 187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional discharge of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022.53(e)(1), an allegation of special circumstances in violation of Penal Code section 190.2(a)(22), several felony counts of attempted murder in violation of Penal Code section 664/187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional discharge of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022.53(e)(1), one felony count of participation in a criminal street gang in violation of Penal Code section 186.22(a), one felony count of assault with a firearm in violation of Penal Code section 245(a)(2), and one felony count of possession of a firearm in violation of Penal Code section 12025(a)(2). Marcus Blueford (DOB: 1/9/1992 CTN: 11012093) is charged with one felony count of murder in violation of Penal Code section 187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional discharge of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022(e)(1), an allegation of special circumstances in violation of Penal Code section 190.2(a)(22), several felony counts of attempted murder in violation of Penal Code section 664/187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional discharge of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022.53(e)(1), one felony count of participation in a criminal street gang in violation of Penal Code section 186.22(a), one felony count of assault with a firearm in violation of Penal Code section 245(a)(2) and one felony count of possession of a firearm in violation of Penal Code section 12025(a)(2). Gethsemane Pita (DOB: 5/25/1992 CTN: 11012095) is charged with one count of accessory to murder in violation of Penal Code section 32, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), one felony count of participation in a criminal street gang in violation of Penal Code section 186.22(a) and one felony count of possession of a firearm in violation of Penal Code section 12025(a)(2). Bail is set at $1 million. On Tuesday, July 19, 2011, defendant Pita pled not guilty to all counts and allegations.

Raheem Jackson, age 17 (charged as an adult), is charged with one felony count of murder in violation of Penal Code section 187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional discharge of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022(e)(1), an allegation of special circumstances in violation of Penal Code section 190.2(a)(22), several felony counts of attempted murder in violation of Penal Code section 664/187, an allegation of commission of a crime in association with a criminal street gang 186.22(b)(1), an allegation of intentional discharge of a firearm in violation of Penal Code sections 12022.5, an allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d), an allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022.53(e)(1), one felony count of participation in a criminal street gang in violation of Penal Code section 186.22(a), one felony count of assault with a firearm in violation of Penal Code section 245(a)(2) and one felony count of possession of a firearm in violation of Penal Code section 12025(a)(2). Bail is set at $6 million. On Tuesday, July 19, 2011, defendant Jackson pled not guilty to all counts and allegations.

The search and arrest warrants associated with these defendants were served in San Francisco, Fremont and Oakland. The defendants whose charges are outlined above are currently in custody. An outstanding warrant remains for one additional adult male suspect.

According to court documents, Ms. Schroer, a tourist visiting from her native Germany, was gunned down on August 8, 2010 in San Francisco at the intersection of Geary and Mason streets. At the same time, two other bystanders were wounded. The individuals accused of the shooting are alleged to be gang members. The San Francisco Police Department is responsible for the extensive and ongoing investigation into this case. Assistant District Attorney Eric Fleming is the prosecutor. Jean Hassett is the Victim Witness Advocate assigned to the case. On Monday, June 13, 2011, Eric Fleming informed the court that the District Attorney’s Office would not seek the death penalty in these cases. The cases were continued to Thursday, August 4, 2011 at 1:30 p.m. for discovery and to set the preliminary hearing.
