District Attorney Gascón Charges Defendant in Hit-And-Run Involving 9-Year-Old Boy and Adult Female

DISTRICT ATTORNEY GASCÓN CHARGES DEFENDANT IN HIT-AND-RUN
INVOLVING 9-YEAR-OLD BOY AND ADULT FEMALE

SAN FRANCISCO – District Attorney George Gascón announced on August 8, 2011 that Andrew Alan Vargas (DOB: 11/7/1989) has been charged with two counts of felony drunk driving with injury and one felony count of hit-and-run with injury which also carries an allegation of causing great bodily injury. One of the drunk driving with injury charges outlines violations of the vehicle code section that include: driving with an open container, failure to stop at a red light, driving the wrong way on a one-way street and failure to yield the right of way to a pedestrian.

“The conduct alleged in this case is egregious,” said District Attorney George Gascón. “Driving is a privilege that carries a great deal of responsibility. Anyone who puts other drivers or pedestrians’ lives at risk with reckless, careless behavior should not be behind the wheel and if they are, they should be prosecuted.”

The criminal charges stem from an August 4, 2011 incident in which an adult female and a nine-year-old boy were struck by a vehicle alleged to be driven by Andrew Alan Vargas. The victims were hit at the intersection of Mission and New Montgomery Streets in San Francisco at approximately 11:30 pm.

Having posted bail in the amount of $65,000, defendant Vargas is currently out of custody. He is scheduled to appear in Department 9 of San Francisco Superior Court and be arraigned on the charges on Thursday, August 11, 2011 at 1:30 pm.
