District Attorney George Gascón Announces Scheduled Arraignment of Suspects in German Tourist Shooting Case

SCHEDULED ARRAIGNMENT OF SUSPECTS IN GERMAN TOURIST SHOOTING CASE

SAN FRANCISCO – District Attorney George Gascón announced today the scheduled arraignment of five adult suspects for the August 2010 shooting death of 50-year-old Mechthild Schroer and the wounding of two other victims.

“This was an outrageous and shocking crime,” said District Attorney George Gascón. “The reckless and brazen conduct of these killers is unconscionable. I thank the men and women of the San Francisco Police Department and the District Attorney’s Office for their diligence and perseverance in pulling this complicated case together so that these individuals could be charged for their alleged crimes against these victims and our City.”

Following arrests made by the San Francisco Police Department on May 4, 2011 after the issuance of arrest and search warrants by the San Francisco District Attorney’s Office on May 2, 2011 and May 3, 2011, the defendants appeared today before the Honorable Jeffrey Ross for arraignment at 1:30 pm in Department 12 of San Francisco Superior Court on Thursday, May 5, 2011. The arraignment of all of the defendants facing the charges outlined below was put over to May 16, 2011 in Department 12 at 1:30pm.

Phillip T. Stewart, age 19, (CTN: 11012091)
· 1 felony count of murder in violation of Penal Code section 187
o An allegation of commission of a crime in association with a criminal street gang 186.22(b)(1)
o An allegation of intentional use of a firearm in violation of Penal Code sections 12022.5
o An allegation of use of a firearm causing great bodily injury in violation of Penal Code section 12022.53(d)
o An allegation of use of a firearm in support of a criminal street gang in violation of Penal Code section 12022(e)(1)
o An allegation of special circumstances in violation of Penal Code section 190.2(a)(22)

· 1 felony count of possession of a firearm in violation of Penal Code section 12025(a)(2)
Bail is set at $1 million.

A sixth individual, 17-year-old Raheem Jackson, was also charged as an adult for his alleged involvement in the crimes committed. He was not scheduled for arraignment on May 5, 2011 with the adult defendants but did appear in Department 12 before Judge Ross with his attorney. His next court appearance is likely to be set for arraignment on May 6, 2011 before Judge Ross in Department 12 of San Francisco Superior Court at 1:30pm. Judge Ross indicated that defendant Jackson’s arraignment would be put over at that time until Monday, May 16, 2011 in Department 12 at 1:30. Defendant Jackson is specifically charged with:

Raheem Jackson, age 17 (charged as an adult)
· 1 felony count of murder in violation of Penal Code section 187

The search and arrest warrants associated with these defendants were served in San Francisco, Fremont and Oakland. The defendants whose charges are outlined above are currently in custody. An outstanding warrant remains for one additional adult male suspect.

According to court documents, Ms. Schroer, a tourist visiting from her native Germany, was gunned down on August 8, 2010 in San Francisco at the intersection of Geary and Mason streets. At the same time, two other bystanders were wounded. The individuals accused of the shooting are alleged to be gang members.

The San Francisco Police Department is responsible for the extensive and ongoing investigation into this case headed Lt. Lea Militello. Assistant District Attorney Eric Fleming is the prosecutor. Jean Hassett is the Victim/Witness Advocate assigned to the case.
