MAN CONVICTED OF SEXUAL ASSAULT
Investigation Leads to New Charges in a Second Case

SAN FRANCISCO, CA – District Attorney George Gascón announced today that Juan Gomez, (CTN 10000058), was convicted of sexual assault and has been charged with rape in a separate, unrelated attack.

“This defendant has been charged and convicted for sexually violating a woman,” said San Francisco District Attorney George Gascón. “By taking this defendant off our streets we can bring a measure of peace to the woman who was assaulted and keep anyone else from falling victim to these criminal acts of cowardly violence.”

Late in the day on June 14, 2011, a jury found that the defendant was guilty of one count of sexual penetration by force in violation of Penal Code section 289(a)(1). The guilty verdict was handed down after less than three hours of deliberation following a two-week jury trial before the Honorable Anne-Christine Massullo in Department 25 of San Francisco Superior Court.

Defendant Gomez, who is 23 years old and a resident of San Francisco, was arrested on January 1, 2010. According to court document, defendant Gomez, approached a 25-year-old woman on 20th street between South Van Ness and Shotwell Avenues at approximately 11:50pm on New Year’s eve December 31, 2009. The defendant grabbed the victim from behind and the two of them stumbled to the ground. The victim resisted and screamed for help. During the struggle the defendant digitally penetrated the victim several times. A good Samaritan responded to the victim’s screams and the defendant fled on foot. The defendant was chased down by the good Samaritan. During the course of the chase, officers from the San Francisco Police Department apprehended the suspect and took him into custody.

As a result of the investigation into this case, a second woman who was also allegedly attacked by the defendant in September of 2009 was identified. Defendant Gomez is awaiting preliminary hearing on charges that he raped, assaulted with force likely to cause great bodily injury and falsely imprisoned that second 31-year-old victim. There is also a one-strike allegation charged for having committed an offense against more than one victim. DNA evidence presented as part of the case for which the defendant has been convicted and is currently awaiting sentencing, assisted in the identification of the second alleged victim.

Having been convicted of one count of sexual penetration by force, the defendant faces a maximum statutory penalty of eight years in state prison. The sentencing of defendant Gomez is scheduled for July 5, 2011 before Judge Massullo in Department 25.

This conviction is the result of an investigation by San Francisco Police Inspector Sidney Laws and District Attorney Investigator Jimmy Posada. The Victim Witness Advocate assigned to support the victims and witnesses in this case is Jerdine Clarke. Kin Tong is the Assistant District Attorney who prosecuted the adjudicated case. He is also the prosecutor handling the pending matter which is scheduled to set for preliminary hearing on June 22, 2011 in Department 20 of San Francisco Superior Court.
