After the beating, the complaint further alleges, Mr. De La Rosa retrieved one of the beers he had tried to steal previously, throws the bat at a second victim who was present in the store and then runs in to the passenger side of a waiting vehicle that departs westbound on Balboa Street.
Mr. De La Rosa is scheduled to be arraigned on October 6, 2023, in Department 10 of the Hall of Justice. The District Attorney’s Office will file a motion to detain Mr. De La Rosa pending trial because of the public safety risk he poses. If convicted of all charges he faces up to life in State Prison.
