San Francisco, CA – San Francisco District Attorney Brooke Jenkins announced today that her office secured a conviction of Derrick Hunter (30), after a trial by jury for being in possession of a semi-automatic firearm after being prohibited from possession of firearms because of a prior adjudication. Mr. Hunter was convicted of being a prohibited person in possession of a firearm (PC 29820(b)), carrying a loaded firearm (PC 25850(a)), possession of a large capacity magazine (PC 32310(a)), possession of ammunition by a prohibited person (PC 30305(a)(1)), carrying a concealed firearm (PC 25400(a)(2)) and two counts of resisting, delaying or obstructing a peace officer (PC 148(a)(1)). The jury also found true several allegations including that he was not in lawful possession of a firearm (PC 25850(c)(4) and that he was not the registered owner of the loaded weapon (PC 25850(c)(6)).
“I would like to thank the jury for their service in this trial,” said District Attorney Brooke Jenkins. “The jury’s verdict holds Mr. Hunter accountable for his crimes and ensures that he now face consequences for violating our laws. My office will continue to do everything we can to prevent gun violence. Ensuring that individuals who are forbidden from guns and ammunition are held accountable when they break the law makes our city safer.”
According to evidence and other testimony presented at trial, on April 17, 2023, officers from SFPD’s Bayview Station received a walk-in report of a battery. The victim identified Mr. Hunter as the suspect, and officers successfully located Mr. Hunter on the 700 block of Kirkwood Avenue. Officers explained that Mr. Hunter was being detained as a suspect in a reported battery, and Mr. Hunter tried to run. During a struggle with police, Mr. Hunter retrieved a semiautomatic Glock from his waistband and threw it towards a nearby drop-off. Officers placed Mr. Hunter in handcuffs and retrieved the weapon, which was found to have a red dot sight and an extended magazine. Mr. Hunter was prohibited from possessing firearms and ammunition as a result of a prior adjudication.
The case against Mr. Hunter was successfully prosecuted by Assistant District Attorney Henry Gage III, with assistance from paralegals Rayna Bryan, Aareona Miles and Jen Java. Prosecutors were able to develop a strong case against Mr. Hunter based on the careful investigation of the San Francisco Police Department’s Bayview Station and expert witness testimony at trial.
“Officers from Bayview Station demonstrated remarkable restraint during this incident, and used minimal force to successfully detain Mr. Hunter,” said Assistant District Attorney Henry Gage III. “Officers’ ability to successfully disarm Mr. Hunter prevented a potentially tragic outcome, and their subsequent investigation has resulted in Mr. Hunter being held accountable for possessing an unlawful firearm.”
Mr. Hunter is currently out of custody. Sentencing will be scheduled on November 7, 2024.
