San Francisco, CA – San Francisco District Attorney Brooke Jenkins announced today that her office secured a conviction of Timothy Lewinsky (49), after a trial by jury for vandalizing two cars in the Mission district. Mr. Lewinsky was convicted of two counts of vandalism for less than $400 (PC 594(b)2(A).
“I would like to thank the jury for their service in this trial,” said District Attorney Brooke Jenkins. “My office takes these cases seriously and will do everything we can to get justice in the courtroom. The jury’s verdict sends a message that this kind of behavior will not be condoned in San Francisco.”
According to evidence and other testimony presented at trial, on August 31,2021, just after 7:00 a.m. San Francisco Police Department Officers responded to reports of a man, Mr. Lewinski, causing a flurry of destruction along Alameda Street near Treat Avenue. A witness saw Mr. Lewinski hurling objects onto the sidewalk before picking up a metal tent pole and smashing it into the front headlight of a Mitsubishi SUV, shattering it completely. The witness described Mr. Lewinski as having a temper tantrum meltdown, and regrettably taking out his frustration on several vehicles in the area. Mr. Lewinski then continued down the street, kicking the rear passenger door of a Subaru hard enough to leave a visible dent, and throwing a metal chair at the side of a Toyota minivan, scraping the paint and leaving another dent. Thanks to the quick work of the civilian witness, University of California San Francisco Police Officers, and San Francisco Police Department Officers, Mr. Lewinski was detained on scene without incident.
The case against Mr. Lewinsky was successfully prosecuted by Assistant District Attorney Sarah Quiñones, with assistance from paralegals Josh Nickchen and Raquel Paz Aleman and the subpoena unit. Prosecutors were able to develop this case based on the San Francisco Police Department’s Mission Station’s and University of California San Francisco Police Department’s thorough investigation and attention to detail.
“Destruction of property will not be tolerated in San Francisco,” said Assistant District Attorney Sarah Quiñones. “We are proud to deliver justice for victims of property crimes, who historically were too often overlooked, and to send a clear message that our city stands with those impacted by senseless acts of vandalism.”
