MAN CONVICTED OF ASSAULT, VIOLATING COURT ORDERS, MAKING CRIMINAL THREATS AND CHILD ENDANGERMENT

San Francisco District Attorney Brooke Jenkins announced today that her office secured a conviction of Orlando Foster (36), after a trial by jury. Mr. Foster was convicted of making criminal threats (PC 422(a)), simple assault (PC 240), two counts of abusing or endangering the health of a child (PC 273a(b)), two counts of disobeying a domestic relations order (PC 273.6(a)), and resisting, obstructing, delaying of a peace officer (PC 148(a)(1).

“I would like to thank the jury for their service in this trial,” said District Attorney Brooke Jenkins. “Compliance with restraining orders is not optional. We take these cases seriously as violations of restraining orders are often the precursor to greater violence. Intervening now, and ensuring there is accountability may prevent an escalation or tragedy in the future.”

According to the testimony and evidence presented at trial, on December 13, 2023, the San Francisco Superior Court issued a domestic violence civil restraining order, ordering Mr. Foster to stay 100 yards away from the protected parties. On the evening of July 14, 2024, the protected party exited her residence with her children to go to a nearby corner store. Mr. Foster suddenly appeared, approached the protected party and became verbally aggressive. Following the incident, in the afternoon of August 4, 2024, the protected party was visiting family with her two children. She drove to the front gate, parked and exited the vehicle with her children to unlock the gate when she noticed Mr. Foster standing next to the vehicle. She requested that Mr. Foster move away from her vehicle. At that time, Mr. Foster began threatening to physically harm and kill the protected party. After she unlocked the gate and got back into her vehicle to drive through the open gate, Mr. Foster aggressively approached the vehicle and continued to yell at the protected party. He then reached into the vehicle and hit her in the face. Multiple witnesses contacted 9-1-1. Mr. Foster fled before officers arrived.

In the late afternoon of March 25, 2025, Mr. Foster was again within the vicinity of the protected party. Upon seeing him, she immediately called 9-1-1. Officers arrived but Mr. Foster had already fled the scene. While canvassing the area, officers observed Mr. Foster walking, he made direct eye contact with them and immediately began to flee on foot. Officers began a foot pursuit as Mr. Foster ran and continuously ignored officers’ commands to stop running. In his attempt to avoid arrest, Mr. Foster entered a nearby residence and did not comply with commands to exit. Officers eventually obtained consent from the residents to enter the home where they were able to take Mr. Foster into custody.

The case against Mr. Foster was successfully prosecuted by Assistant District Attorney Madison Boucher with assistance from District Attorney Investigators Dana Lee, Rosanna Figueroa, and paralegals Lena Ku and Loretta Luu and the Subpoena Unit. Victim Advocate Cody Martinez worked closely with the victim through the pendency of this case. Prosecutors were able to develop a strong case against Mr. Foster based on the work of SFPD patrol officers who responded to the scene and the SFPD’s Crime Gun Investigations Center.

“Domestic violence is unfortunately an occurrence that plagues our community” said Assistant District Attorney Madison Boucher. “I commend the victim for having the courage to come forward and testify. I also want to thank the jury for their diligence during deliberations. We will continue to fight to protect those who are survivors of domestic violence.”

Mr. Foster is currently being held in custody. His sentencing date is July 1, 2025.
