San Francisco, CA – San Francisco District Attorney Brooke Jenkins announced today that her office secured a conviction of Mitchell Hoyt (34), after a trial by jury for breaking into an Upper Market Home and stealing an electric scooter while the residents were present. Mr. Hoyt was convicted of first-degree burglary (PC 459).
“I would like to thank the jury for their service in this trial,” said District Attorney Brooke Jenkins. “The jury’s verdict holds Mr. Hoyt accountable for his crimes and sends a clear message that brazen, broad daylight burglaries will not be tolerated. My office takes these cases seriously and will continue to do everything we can to keep moving forward to ensure that justice is done for victims of crime.”
According to evidence and other testimony presented at trial, on March 15, 2024, Mr. Hoyt scaled a fence leading to the backyard of a residential building on the 3700 block of Market Street, in broad daylight, where the victims lived. Mr. Hoyt jumped into the backyard patio and walked towards the victims’ garage located on the first floor of the residence. He then entered the garage and stole a motorized scooter belonging to one of the residents before fleeing. The residents were all home while this was happening and two of them tried to chase Mr. Hoyt while he fled on the scooter, but he got away. The entire incident was captured on surveillance video. On April 16, 2024, a San Francisco Police Officer observed Mr. Hoyt in the Fisherman’s Wharf area and arrested him.
The case against Mr. Hoyt was successfully prosecuted by Assistant District Attorney Angela Roze, with assistance from District Attorney Investigator Sammy Kim, paralegal Aareona Miles and IT support from Noaeh Pinaire. Prosecutors were able to develop a strong case against Mr. Hoyt based on the careful investigation of the San Francisco Police Department’s Central Station.
“San Francisco residents deserve to feel secure in their homes and not have property stolen from them in broad daylight,” said Assistant District Attorney Angela Roze. “I would like to thank the jury for their careful consideration of the evidence and the law in this case, holding Mr. Hoyt accountable for his actions.”
Mr. Hoyt is currently in custody. Sentencing is scheduled for October 28, 2024.
