San Francisco, CA – San Francisco District Attorney Brooke Jenkins announced today that her office secured a conviction of Linda Martin (70), after a trial by jury for contacting and yelling at an elderly woman who had a restraining order against her. Ms. Martin was convicted of violating a court order (elder abuse restraining order) (PC 166(a)(4)).
“I would like to thank the jury for their service in this trial,” said District Attorney Brooke Jenkins. “Compliance with restraining orders is not optional. The jury’s verdict holds Ms. Martin accountable and sends a clear message that restraining order violations will not be tolerated by San Franciscans.”
According to testimony and other evidence presented at trial, on May 4, 2024, at approximately 10:08 AM, San Francisco Police responded to a call for service regarding the violation of an elder abuse restraining order. Upon arrival, officers heard Ms. Martin yelling down the block. The 78-year-old victim informed Officer Hung that she had taken out a restraining order against Ms. Martin, her tenant at a different address, in 2022. However, despite the clear and emphatic language of that order which prohibited any contact, communication, or approaching within 100 yards of the victim or her front door, Ms. Martin had shown up that morning. Ms. Martin came to the victim’s front door, began pounding on the door so hard that the victim feared she was going to break it down, and when the victim came to the door, called her names and racial slurs.
The case against Ms. Martin was successfully prosecuted by Assistant District Attorney Owen Nelson with assistance from District Attorney Investigator Teddy Martin, and paralegals Joshua Nickchen and Raquel Paz. Prosecutors were able to develop a strong case against Ms. Martin based on the San Francisco Police Department’s investigation and assistance.
“I want to thank the jury for their thoughtful and careful review of the evidence, as well as the victim and her family for their courage and support throughout the process of this case,” said Assistant District Attorney Owen Nelson. “This conviction shows that the people of San Francisco recognize that court orders are more than just pieces of paper and represents our community’s continued commitment to the protection of those among us that are the most vulnerable.”
Ms. Martin is currently out of custody. Sentencing is scheduled for March 7, 2025.
