San Francisco, CA – Today, San Francisco District Attorney Brooke Jenkins announced that Hai Van Le (48) was charged with murder in connection to a fatal hit and run. Mr. Le was arraigned on December 10, 2025, and pleaded not guilty to all charges and denied the allegations. Mr. Le is charged with murder, driving under the influence of alcohol causing injury, driving under the influence of alcohol causing injury with a blood alcohol level of .08% and leaving the scene of a crash.
The District Attorney’s Office moved to have him detained pending trial without bail due to the public safety risk he poses. The court released Mr. Le over prosecutors’ objections and ordered that he be held in home detention with electronic monitoring. He is also ordered to not consume any drugs or alcohol, participate in two Alcoholics Anonymous classes per week and not to drive. Mr. Le is also ordered to have no contact with the victim’s next of kin, and to make no attempts to obtain a passport or visa. Mr. Le’s next court date is December 22, 2025, for a status and prehearing conference.
According to court documents, on October 26, 2025, SFPD officers were dispatched to the area of Ocean Avenue and Ashton Avenue where at approximately 6:42 p.m., they found the victim on the ground in the east crosswalk. Medics on-scene pronounced the victim deceased at 6:47 p.m. A witness on scene provided dashcam footage of the incident. In the footage, Mr. Le’s vehicle is allegedly stopped at a red light and then when the light turns green proceeds through the intersection. Allegedly, Mr. Le’s car is then seen driving over the victim, who was in the opposite crosswalk. The video also allegedly shows Mr. Le’s brake lights activated and the vehicle briefly slowed down before continuing to drive eastbound on Ocean Avenue.
Although charges have been filed, and this case is being handled by the San Francisco District Attorney’s Felony DUI Vertical Prosecution Unit, this remains an active investigation.
