FOUR MEN PLEAD GUILTY IN CONNECTION TO 2023 DRIVE-BY SHOOTING

Successful SFPD, OPD, ATF and FBI interagency collaboration and investigation across two counties resulted in successful prosecution and conviction of four individuals and seizure of multiple firearms

Each defendant to be sentenced to state prison in connection to drive-by shooting that left one victim seriously injured and a home in San Francisco riddled with gunfire

San Francisco, CA – Today, San Francisco District Attorney Brooke Jenkins announced that four men have pled guilty in connection a 2023 drive by shooting that resulted in serious injury to one victim and a home on a residential street riddled with bullet holes. Phillip Stewart (33) and Jahari Oliver (28) each pled guilty to assault with a semi-automatic firearm (PC 245(b)) and admitted that they each were armed with a firearm in the commission of the crime (PC 12022(a)). Each man will be sentenced to 10 years in State Prison for these crimes.

Shaquille Dumetz (32) pled guilty to attempted murder (PC 664/187) and was sentenced to seven years in State Prison on November 7, 2025.

Cory Martin-Turner (31) also pled guilty on November 7, 2025, to assault with a semi-automatic firearm (PC 245(b)) and was sentenced to six years in State Prison.

“I would like to thank the San Francisco Police, Oakland Police, the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Federal Bureau of Investigation for their excellent coordination and investigation in this case, said District Attorney Brooke Jenkins. “These convictions and sentences hold these men accountable for a brazen mid-afternoon drive-by shooting. Although, I am grateful no lives were lost in this incident, it should be clear to them that gun violence will never be normalized nor tolerated in San Francisco. Anyone with the intention of coming to San Francisco to engage in violence, with the belief that they will get off with no consequences is mistaken. Perpetrators of crime will be identified, arrested and prosecuted. Law enforcement agencies at all levels are aligned and will continue working together to protect the safety of the public.”

Our District Attorney and her team were relentless in ensuring these perpetrators face justice for this crime, which makes our city safer.”

We remain united, persistent, and committed to working side by side with our partners to keep our neighborhoods safe and protect the people who call the Bay Area home.”

According to court records on September 7, 2023, at approximately 1:00 p.m., Mr. Stewart, Mr. Oliver, Mr. Dumetz and Mr. Martin-Turner, were captured on a Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) camera in Oakland leaving a residence on 64th Avenue Place, and getting into two vehicles, a dark colored Hyundai driven by Mr. Martin-Turner and an Infiniti G37 driven by Mr. Stewart.

At approximately 2:10 p.m., the Infiniti G37 pulled up and fired multiple rounds with one round striking the victim in the thigh while the others caused damage to the door, wall, and window frame of a residence on the 1100 block of Donner Avenue in San Francisco. The victim was conversing with an unknown person inside of a parked vehicle adjacent to the residence, which was occupied, when the shots rang out.

The San Francisco Police Department responded to the residence and recovered twelve cartridges. Upon reviewing surveillance footage, investigators with the San Francisco Police Community Violence Reduction Team observed that the perpetrator’s vehicle was the same vehicle captured in the ATF video leaving the residence on 64th Avenue Place in Oakland. Further review indicated the assailants in the front and rear passenger seats were armed with firearms. The individual in the front passenger seat was captured holding a rifle and wearing light-colored gloves consistent with those worn by Mr. Oliver prior to the shooting in the ATF video.

The San Francisco Police Department conducted an exhaustive investigation spanning jurisdiction around the Bay Area. Using state-of-the-art technology to assist in the investigation, Officers identified four suspects in the shooting with known associations to three different gangs in the city. Officers obtained no bail arrest warrants for the suspects, and in February 2024, officers executed the warrants at seven locations around the Bay Area.

Officers arrested all four suspects and seized multiple illegal firearms – including eight handguns and a rifle along with ammunition and magazines.

Mr. Stewart and Mr. Oliver are each currently in custody. Formal sentencing is scheduled for March 18, 2026, in Department 13 at the Hall of Justice.

The case against Mr. Stewart and Mr. Oliver was successfully prosecuted by Assistant District Attorney Korey Bell, with support from Victim Witness Advocates Liliana Bueno and Tracy Wu, who worked diligently to keep the victim’s family informed and involved throughout the pendency of this case. Prosecutors were able to develop a strong case against all of the individuals involved in the drive-by shooting based on the outstanding collaboration and investigation of the San Francisco Police Department’s Community Violence Reduction Team and Crime Gun Investigations Center, Oakland Police Department, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Federal Bureau of Investigation.

“This result would not have been possible but for the collaboration between the investigative agencies, and the City and County of San Francisco is appreciative of their efforts,” said Assistant District Attorney Korey Bell. “The defendants conspired to discharge a firearm at a person within city limits—several rounds ultimately landed inside of a person’s home. This type of the conduct will not be tolerated, and I hope that this case will serve as a warning to those who believe that they will not face consequences for violent crimes committed in San Francisco.”
