JURY CONVICTS MAN FOR SELLING FENTANYL NEAR POWELL STREET BART STATION

San Francisco, CA – San Francisco District Attorney Brooke Jenkins announced today that her office secured a conviction of Sebastian Garcia (31), after a trial by jury for drug dealing in the Hallidie Plaza. Mr. Garcia was convicted of sale of a controlled substance (H&S 11352(a)) and two counts of possession for sale of fentanyl and cocaine base (H&S 11350).

“I would like to thank the jury for their service in this trial,” said District Attorney Brooke Jenkins. “The jury’s verdict holds Mr. Garcia accountable and my message to drug dealers and their enablers is simple – we will not relent. Although there is still much work to be done, we will remain laser-focused on shutting open-air drug markets down and delivering justice.”

According to testimony and other evidence presented at trial, on July 9, 2025, at approximately 10:20 p.m. San Francisco Police plain clothes officers entered the upper part of the Hallidie Plaza at the entrance of the Powell Street BART Station as part of an undercover operation. One undercover officer approached Mr. Garcia, who then engaged the officer and offered to sell him fentanyl and cocaine base. After the sale was completed an arrest team was able to come in and arrest Mr. Garcia. When Mr. Garcia was searched, cocaine base, fentanyl and the money used by the undercover officer were located on his person.

The case against Mr. Garcia was successfully prosecuted by Assistant District Attorney Elizabeth Jimenez, with assistance from paralegal Katelyn Figueroa, legal assistant Daniel La, Hang Ngo from the Subpoena Unit and IT support from Noaeh Pinaire and Leland Chan. Prosecutors were able to put on a strong case, thanks to the officers who took part in this Drug Market Agency Coordination Center (DMACC) operation, from the San Francisco Police Department’s Narcotics Team, Tenderloin Plain Clothes Unit and the Sheriff’s Office.

“Officers who participate in these types of operations put their safety at risk to make our city safer,” said Assistant District Attorney Elizabeth Jimenez. “I want to thank the jury who listened to all the evidence in this case and held Mr. Garcia accountable for his actions, in doing so the jury recognized the efforts made by the San Francico Police Department in taking these dangerous drugs off the street.”

Mr. Garcia is currently in custody. He faces up to five years in state prison. Sentencing is scheduled for November 13, 2025.
