San Francisco, CA – San Francisco District Attorney Brooke Jenkins announced today that her office secured a conviction of Kevin Chavez (41), after a trial by jury, following an incident where he took a woman’s phone while she was calling 9-1-1 to report an emergency. Mr. Chavez was convicted of damaging a communication device (PC 591.5), vandalism causing more than $400 in damage (PC 594(b)(1)), and theft (PC 484(a)).
“I would like to thank the jury for their service in this trial,” said District Attorney Brooke Jenkins. “The jury’s verdict holds Mr. Chavez accountable for his conduct and sends a message that this conduct will not be tolerated. We take cases like this very seriously because this kind of behavior is scary, unlawful and may be the precursor of future acts of violence we want to prevent from happening.”
According to testimony and other evidence presented at trial, on December 29, 2025, Mr. Chavez got into a verbal and physical altercation with the victim. While arguing he took her cell phones, keeping one and throwing the other, that she was using to call 9-1-1 with, over a fence midway through the 9-1-1 call. Mr. Chavez then walked to the victim’s home where he broke her window and garage door, eventually entering her home.
The case against Mr. Chavez was successfully prosecuted by Assistant District Attorney Mary Polk, with invaluable assistance from District Attorney Investigator Dana Lee, paralegals Lee-Ann Collins, Lena Ku, and Aareona Miles, and IT support from Noaeh Pinaire. Victim advocate Tatiana Guardado worked closely with the victim throughout the pendency of this case. Their preparation and attention to detail combined with a thorough investigation from SFPD’s Mission and Northern Station officers ensured that the evidence was presented clearly and thoroughly.
“I would like to thank the jury for their careful attention and return of a just verdict in this case,” said Assistant District Attorney Mary Polk. “I would also like to commend the victim for her strength and courage during those difficult days of testimony. I hope this verdict gives her comfort as she moves on with her life.”
