ARMED MAN CHARGED WITH POSSESSION FOR SALE OF NARCOTICS IN TENDERLOIN

San Francisco, CA – Today, San Francisco District Attorney Brooke Jenkins announced that Martinez Guillory (51), was charged in connection with a possession of narcotics for the purposes of sales while armed, in the Tenderloin. Mr. Guillory is charged with one count of possession of a firearm by a felon (PC 29800(a)(1)), one count of carrying a concealed firearm (PC 25400(a)(2)), possession of ammunition (PC 30305(a)(1)), possession for sale of cocaine base (H&S 11351.5), and one count of possession for sale of a controlled substance (H&S 11351). The criminal complaint also alleges that Mr. Guillory was personally armed with a firearm (PC 12022(c)). He is scheduled to be arraigned on December 20, 2024, at 1:30 PM in Department 10 at the Hall of Justice. The District Attorney’s Office moved to have him detained pending trial due to the public safety risk he poses. This is the first case that the San Francisco District Attorney’s Office has filed with an arming allegation since the implementation of Prop 36 on December 18, 2024.

“My office is committed to using every tool available to protect the safety of the public,” said District Attorney Brooke Jenkins. “With the passage of Prop 36, my office now has new tools available that we will use appropriately, as intended by the voters, and move to hold who would break our laws accountable.”

According to court documents, on December 18, 2024, at approximately 7:21 PM BART PD officers saw Mr. Guillory at the Civic Center BART Station follow closely behind another patron who had paid their fare. He then allegedly “piggy backed” behind the patron and exited the paid area without paying his fare. The officer contacted Mr. Guillory and searched his backpack and subsequently found 105.3 grams of suspected heroin, 39.6 grams of cocaine, 59.4 grams of cocaine base, packaging material and a digital scale. The officer also found a 9mm Glock 26 semi-automatic pistol in a backpack. The loaded pistol magazine was in the same compartment as the gun and the magazine was loaded with 17 rounds of ammunition.
