MAN WITH THREE PENDING NARCOTICS CASES CHARGED WITH NEW NARCOTICS TRAFFICKING CASE RELEASED BY COURT

San Francisco, CA – Today, the San Francisco District Attorney’s Office announced that Francis Rivas-Garay (34) has been charged with multiple felonies in connection with narcotics trafficking in SOMA. Mr. Rivas-Garay was arraigned on March 28, 2025, and pleaded not guilty to all charges and denied all allegations. Mr. Rivas-Garay is charged with one count of possession for sale of controlled substances (H&S 11351), one count of sale and giving away a controlled substance (H&S 11352), and one count of possession for sale of methamphetamine (H&S 11378). The criminal complaint also alleges that Mr. Rivas-Garay possessed a substance containing more than one ounce of fentanyl (H&S 11370.4(c)(1)(A) and that Mr. Rivas-Garay committed these offenses after the court released him on three pending felony narcotics cases.

According to court documents, on March 26, 2025, at approximately 11:00 p.m., at the intersection of 5th and Mission Streets, Mr. Rivas-Garay allegedly sold 1.5 grams gross (gg) of fentanyl to an undercover police officer for $15.00 in marked city funds (MCF). The police arrested and searched him and found him in possession of the MCF, $217.00 additional U.S. currency, a cell phone, 53.7 gg fentanyl, and 19.1 gg methamphetamine. At the time of his arrest, Mr. Rivas-Garay was released by the court on three pending felony narcotics cases. When he was last arrested in December 2024, the police found him in possession of 20 grams of fentanyl.

The District Attorney’s Office moved to have Mr. Rivas-Garay detained pending trial because of the public safety risk he poses. The Honorable Judge Sylvia Husing released Mr. Rivas-Garay on his own recognizance. His next court date is April 8, 2025, to set a date for the preliminary hearing in this matter.
